In MCS NETWORK SOLUTION S.A. DE C.V. (“MCS”) we consider essential the transparency and ethical use of information, therefore the protection and privacy of our customers’ data is of utmost importance to us. In compliance with the provisions contained in the Federal Law for the Protection of Personal Data in Possession of Private Parties (“LFDPPP”) in force in Mexico, we hereby share the terms and conditions of the Privacy Notice of MCS with address at Patricio Sanz #1529, Colonia Tlacoquemecatl, Delegación Benito Juárez, Mexico City, C.P. 03200. This Privacy Notice describes the manner in which MCS collects, accesses, uses and discloses your personal information obtained through the use of the MCS website (https://mcs.com.mx/) as well as any subsite of such website.
MCS, as well as its affiliates and subsidiaries, which are part of the same group, operate under the same internal processes and policies, will be responsible for collecting, using, protecting and deciding on the processing of your personal data, in compliance with the data protection principles set forth in Chapter II of the LFDPPPPP.
What information do we collect?
MCS collects the following information only on a voluntary basis and with the consent of its customers:
- Personal data: Refers to information or contact data, which serve to identify your identity, such as your name, personal address, date of birth, telephone number either landline or cell phone, Unique Population Registry Code (CURP), email, among others.
- Sensitive personal data: Refers to personal data that affect the intimate sphere of the owner or that its improper use may generate discrimination or serious risk. Among them are considered data such as racial or ethnic origin, present and future health status, genetic information, religious, philosophical and moral beliefs, union membership, political opinions, sexual preference.
MCS does not proactively collect data that is considered sensitive personal data. In the event that you voluntarily provide such information to us and we receive or record it in our systems, MCS will only use such information to the extent that the use of such data is essential to fulfill the request or service you have requested from us.
What is the purpose of collecting your data?
MCS may collect, use, disclose and store your personal data in order to evaluate and improve our service and product offerings, confirm that the financial information you provide when contracting or purchasing a service or product corresponds to your identity, communicate our newsletter, as well as relevant information from MCS, contact you personally, via telephone or email, for marketing, advertising or commercial prospecting purposes, or in order to follow up on your comments, suggestions or opinions.
MCS ensures that your personal data will not be used for any purpose other than that set forth in this Privacy Notice and that its treatment will be in compliance with the provisions contained in the LFDPPP adhering to the principles of legality, consent, information, quality, purpose, loyalty, proportionality and accountability provided therein.
Transfer of Personal Data
MCS will not sell, assign or transfer your personal data to third parties outside MCS without your prior express consent. However, MCS may transfer your personal data, without your consent, when such transfer is provided for by law.
MCS may share your personal data to both domestic and foreign entities, without your consent, in the following cases:
- Affiliated companies, subsidiaries and/or controlling entities, domestic or foreign or, to any company that operates under the same internal policies regarding personal data protection in order to comply with the purposes informed in this privacy notice;
- When your data must be transferred to a third party for purposes of compliance with any service or product you requested, in order to safeguard your interest; and/or
- Competent authorities in the cases foreseen by the applicable regulations.
MCS will only transfer your personal data without your consent in the aforementioned cases and those provided for in Article 37 of the LFDPPPPP.

A “cookie” is a file that is sent with the purpose of requesting permission to be stored on your computer, when you accept, this file is created and the cookie is used to have information regarding web traffic, as well as to facilitate future visits to a recurring website. On the other hand, cookies can recognize you individually and therefore provide you with a personalized service of your website.

Protection Measures
MCS has implemented and maintains administrative, physical, and technical security measures to protect your personal data (including sensitive personal data), against damage, loss, alteration, destruction or unauthorized use, access or treatment, as well as to keep them in a correct and updated way for the purposes for which they were collected, in accordance with the provisions of Article 19 LFDPPP. However, it is important to consider that no data transmission over the Internet is completely secure and risk-free. Therefore, MCS cannot guarantee that the processing of your personal data will be free of any damage, loss, alteration, destruction or unauthorized use, access or treatment, in case MCS detects that security breaches have occurred that significantly affect the economic or moral rights, it will notify the holder in compliance with the provisions of Article 20 LFDPPPPP.
What are ARCO rights?
ARCO rights are the rights granted by law to you as the owner of personal data. You may exercise your rights of access, rectification, cancellation and opposition at any time. Likewise, you may revoke, at any time, the consent you have given and that was necessary to carry out the processing of your personal data, as well as request to limit the use or disclosure of the same. - Right of Access to your Personal Data: You, upon proof of your identity, shall at all times have the right to access your personal data held by MCS.
- Right to Rectification of your Personal Data: You have the right to request the rectification of your personal data in possession of MCS in case they are inaccurate, incorrect, imprecise, incomplete or not updated, indicating which are the data to be rectified and the correction to be made. This request must be accompanied by the documentation that evidences the origin of the request.
- Right of Cancellation of your Personal Data: You have at all times the right to cancel your personal data through the means established in this Privacy Notice, which will involve the cessation of the processing of your personal data by MCS, by blocking them and their subsequent dissociation.
- Right of Opposition to the processing of your Personal Data: You may, at any time, oppose the processing of your personal data for specific purposes or demand the cessation thereof when there is legitimate cause and your specific situation so requires, which must be justified by the request.
The exercise of the right of opposition will not proceed in those cases in which the treatment is necessary for the fulfillment of an obligation imposed on MCS, and in the cases provided for in Article 26 of the LFDPPPPP.
We inform you that, in case of refusal of response to requests for ARCO rights or disagreement with it, you can file with the Federal Institute of Access to Information and Data Protection, the corresponding Request for Protection of Rights in the terms and terms set by the LFDPPPPP.
Changes to the Privacy Notice
MCS reserves the right to make changes to this Privacy Notice, which will be communicated to you through the website https://mcs.com.mx.
